Wiwa v. Shell: Absent a Trial, Can a Winner Be Declared?

Goldhaber In this video clip, The American Lawyer's senior international correspondent, Michael Goldhaber, discusses the history and development of the Alien Tort Statute, and analyzes the settlement reached earlier this week in Wiwa v. Shell.

Shell agreed to a $15.5 million settlement of the 13-year case on June 8. Had it gone to trial, Wiwa v. Shell was widely expected to be the breakthrough case for corporate human rights. Goldhaber analyzed the outcome--arguing that, even absent a trial, corporate human rights did win--earlier this week on our blog.

This video was produced by Witness, a nonprofit organization dedicated to using video and online technologies to document human rights abuses worldwide and to promote justice and change. The organization was founded in 1992 by musician and activist Peter Gabriel and the Reebok Human Rights Foundation as a project of the Lawyers Committee for Human Rights (now Human Rights First).
