Racketeering Charges in Willie Gary Sex Suit Dismissed

UPDATE: June 22, 5:55 p.m. An initial version of this post picked up on an error by the Daily Business Review, which reported that the case against Willie Gary had been dismissed. In fact, only two substantive counts accusing Gary of racketeering were dismissed. Five counts in the case remain.

The sexual harassment suit against prominent plaintiffs lawyer Willie Gary filed by a former secretary certainly had plenty of scandalous allegations.

But apparently the RICO charges in a 2007 complaint filed by Jillian Nedd weren't compelling enough for a Florida judge to allow them to remain in the case against Gary, of Stuart, Fla.-based Gary, Williams, Parenti, Finney, Lewis, McManus, Watson & Sperando. (Nedd accused Gary of racketeering and raping seven women.)

Am Law Daily sibling publication the Daily Business Review in Miami reports that Martin County circuit judge Elizabeth Metzger dismissed two racketeering charges on the grounds that Nedd failed to establish a pattern of criminal activity or that she suffered direct injuries from Gary's alleged misconduct.

Five counts in the case remain, including allegations of sexual battery and mental distress.

"We are thrilled with the ruling," said Gary's lawyer, Michael Pike of West Palm Beach's Burman, Critton, Luttier & Coleman.

If Judge Metzger tosses the rest of the suit, Gary's lawyers are expected to seek to have Nedd pay the jet-setting plaintiffs lawyer's legal bills, which could exceed $100,000.
